1. Introduction & Acceptance
Welcome to Yourever ("we", "us", or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between Yourever (PT Yourever Teknologi Indonesia) and you ("User", "Tenant", or "you") regarding your access to and use of the Yourever platform, website, applications, and services (collectively, the "Platform").
By creating an account, accessing, or using the Platform in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms in their entirety, you must not access or use the Platform.
2. Definitions
The following terms shall have the meanings set forth below throughout this document:
- "Account" means a registered user account created to access and use the Platform.
- "Content" means all data, text, images, files, customer information, inventory records, transaction history, and other materials uploaded, stored, or processed by the Tenant through the Platform.
- "Tenant" means the individual, business entity, or organization that has registered an Account and uses the Platform to manage rental operations.
- "Tenant Data" means all Content uploaded, created, or processed by the Tenant through the Platform.
- "Service" means the features, functionality, and support provided by Yourever through the Platform, as determined by the subscription tier selected by the Tenant.
- "Subscription" means a recurring paid plan selected by the Tenant (Lite, Pro, or Enterprise).
- "User" means any individual authorized by the Tenant to access the Platform under the Tenant's Account, including administrators, staff members, and operators.
- "Third-Party Services" means any external services, applications, or integrations connected to the Platform, including but not limited to payment gateways, shipping providers, and communication services.
3. Platform Status & "AS IS" Disclaimer
IMPORTANT NOTICE — BETA STATUS: Yourever is currently under active development. Certain features, including but not limited to multi-branch management, "Sovereign Branch Switching", advanced analytics, and other experimental functionalities, may contain bugs, errors, or unexpected behavior. By using the Platform, you expressly acknowledge and accept these technical risks.
3.1 "AS IS" Terms
The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. Yourever does not warrant that the Platform will be uninterrupted, timely, secure, or error-free.
3.2 Beta Features
Features designated as "beta", "experimental", or "preview" are provided for testing and evaluation purposes only. These features may be modified, disabled, or removed at any time without prior notice. Yourever is not liable for data loss, business interruption, or other damages arising from the use of beta features.
3.3 Data Backup Recommendations
Yourever strongly recommends that all Tenants maintain independent backups of their critical business data. While Yourever implements automated backup procedures, you acknowledge that no data transmission or storage system is completely secure or error-free.
3.4 No Reliance
You agree that your use of the Platform is at your own risk. You should not rely on the Platform as the sole means of managing your business operations without proper contingency measures.
4. Account Registration & Eligibility
4.1 Eligibility
To use the Platform, you must be at least 18 years old and capable of forming a binding contract under applicable law. If you are registering on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.
4.2 Account Information
You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. Yourever reserves the right to suspend or terminate Accounts with inaccurate or incomplete information.
4.3 Account Security
You are responsible for maintaining the confidentiality of your Account credentials, including passwords and API keys. You agree to immediately notify Yourever of any unauthorized access or use of your Account. Yourever will not be liable for any loss or damage arising from your failure to comply with these security obligations.
4.4 Multi-Factor Authentication
Yourever strongly encourages and may require the activation of multi-factor authentication (MFA) for administrative-level accounts. You understand that failure to enable MFA may increase the risk of unauthorized access to your Account.
5. Data Ownership & Rights
5.1 Ownership of Tenant Data
Yourever expressly acknowledges and affirms that all Tenant Data — including customer lists, inventory records, transaction history, pricing information, uploaded media, and all other Content — is and shall remain the exclusive property of the Tenant. Yourever claims no ownership, rights, copyright, or intellectual property rights in any Tenant Data.
5.2 Yourever's Role
Yourever acts solely as a technology infrastructure provider and digital warehouse for Tenant Data. We do not use, analyze, sell, rent, or monetize Tenant Data for our own commercial purposes beyond what is necessary to provide the Service.
5.3 License Grant to Yourever
By uploading Content to the Platform, you grant Yourever a limited, non-exclusive, revocable license to use, store, process, display, and transmit your Content solely for the purpose of providing the Service to you. This license does not grant Yourever the right to:
- Sell or license your Content to third parties;
- Use your Content for advertising or commercial purposes unrelated to the Service;
- Disclose your Content to third parties except as required by law or as necessary to provide the Service (e.g., to Third-Party Service providers bound by confidentiality obligations).
5.4 Data Export
You may export your data at any time through the export functionality available on your dashboard. Upon written request, Yourever will assist in exporting your data in standard formats (CSV, Excel, JSON) within thirty (30) calendar days.
5.5 Data Retention After Termination
After Account termination, Yourever will retain your data for a period of ninety (90) days, after which it will be permanently deleted from our active systems, unless retention is required by applicable law. Backup copies may persist for an additional thirty (30) days in our disaster recovery systems.
6. Limitation of Liability
6.1 Exclusion of Indirect Damages
To the maximum extent permitted by applicable law, Yourever and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of revenue, loss of business opportunities, loss of data, business interruption, reputational damage, or cost of substitute services, arising out of or in connection with your access to or use of (or inability to access or use) the Platform.
6.2 Liability Cap
Yourever's total aggregate liability to you for any and all claims arising out of or related to these Terms or the Platform shall not exceed the total amount you paid to Yourever in the three (3) months immediately preceding the event giving rise to such liability.
6.3 System Downtime
In the event of Platform downtime or service interruptions, Yourever's sole obligation is to use commercially reasonable efforts to restore the service. Yourever has no obligation to provide compensation for lost rental income, missed bookings, or other operational losses resulting from technical issues.
6.4 Third-Party Services
Yourever is not responsible for the availability, reliability, or performance of Third-Party Services integrated with the Platform.
6.5 Survival
This Section 6 shall survive any termination or expiration of these Terms.
7. Acceptable Use Policy
7.1 Permitted Use
You agree to use the Platform solely for lawful purposes and in accordance with these Terms. The Platform is designed to support legitimate rental business operations, including equipment rental, property rental, vehicle rental, service booking, and event reservations.
7.2 Prohibited Activities
You are expressly prohibited from using the Platform to:
- Conduct any illegal activities, including fraud, money laundering, terrorist financing, or violation of applicable laws or regulations;
- Upload, store, or distribute any Content that infringes upon the intellectual property, privacy, or other rights of any third party;
- Attempt to gain unauthorized access to the Platform, other user accounts, or Yourever systems, including through hacking, cracking, phishing, or other intrusion techniques;
- Interfere with or disrupt the integrity or performance of the Platform, including through the distribution of malware, denial-of-service (DoS) attacks, or excessive infrastructure load;
- Use the Platform to deceive customers, hide fees, engage in false advertising, or conduct dishonest business practices;
- Sell, rent, sublicense, or transfer access to the Platform to any third party without prior written consent;
- Scrape, crawl, or use automated means to extract data from the Platform without authorization;
- Use the Platform in any way that could damage, disable, overburden, or impair the Platform or interfere with any other party's use of the Platform.
7.3 Enforcement
Yourever reserves the right, at its sole discretion, to suspend or terminate any Account without prior notice for violation of this Acceptable Use Policy. In cases of serious violations, Yourever may report such activities to appropriate law enforcement authorities.
8. Subscription, Payment & Refunds
8.1 Subscription Plans
Subscription fees vary based on the selected plan (Lite, Pro, or Enterprise) and the number of branches. Current pricing details are available on our Pricing page.
8.2 Billing
Subscription fees are billed in advance on a prepaid basis (monthly or annually). All fees are exclusive of applicable taxes unless stated otherwise.
8.3 No Refunds
Except as provided in Section 8.4, all fees paid are non-refundable. No refunds will be provided for partial months of service, downgrade refunds, or unused features.
8.4 Money-Back Guarantee
First-time paid customers are entitled to a 14-day money-back guarantee from the date of the initial payment. To request a refund, you must contact support within this period.
8.5 Price Changes
Yourever reserves the right to change subscription fees with thirty (30) days' prior written notice. If you do not agree with a price change, you may cancel your subscription before the change takes effect.
8.5.1 Founder's Circle Exception
Users enrolled in the Founder's Circle program at the Rp 99,000/month pricing tier are exempt from price increases for the duration of their continuous membership. The Founder's Circle price will remain in effect as long as the Tenant does not cancel their subscription, regardless of price changes to other tiers.
8.5.2 Promotional Pricing & Subsidies
Prices labeled "Crisis Subsidy", "Promotional", or similar terms are temporary and may be withdrawn with 30 (thirty) calendar days' notice. After the promotional period ends, regular pricing will apply in accordance with the price change notice provisions of Section 8.5.
8.6 Late Payment
Accounts that remain unpaid after a seven (7) day grace period may be suspended. Accounts inactive for sixty (60) days after suspension may be permanently deleted along with associated data.
8.7 Subscription Modifications
You may upgrade or downgrade your subscription tier at any time through your Account dashboard. Upgrades take effect immediately; downgrades take effect at the start of the next billing cycle.
8.8 Data Migration Services
The free data migration service ("Free Migration") offered for Lite, Pro, and Founder's Circle tiers is a one-time effort to transfer data from Excel, CSV, or manual record formats to the Platform.
The migration scope is limited to inventory data, customer data, and transaction history provided by the Tenant in supported formats. Yourever is not liable for data entry errors, duplication, or inaccuracies arising during the migration process. The Tenant is responsible for verifying the accuracy of migrated data.
9. Termination
9.1 Termination by You
You may terminate your Account at any time through Account settings or by contacting support. Upon termination, your access to the Platform will cease at the end of the current billing period.
9.2 Termination by Yourever
Yourever may suspend or terminate your Account immediately if: (a) you breach any provision of these Terms; (b) your payment is overdue beyond the grace period; (c) your use of the Platform poses a security risk or legal liability; or (d) required by applicable law or government request.
9.3 Effect of Termination
Upon termination: (a) your license to use the Platform will immediately cease; (b) Yourever may delete your Account and all associated data in accordance with Section 5.5; (c) all provisions of these Terms which by their nature should survive termination shall remain in effect.
10. Intellectual Property
10.1 Yourever's Intellectual Property
The Platform, including all software, code, designs, graphics, logos, trademarks, and documentation, is the exclusive property of Yourever and is protected by applicable intellectual property laws. These Terms do not grant you any rights, ownership, or interest in the Platform or Yourever's intellectual property.
10.2 Feedback
If you provide feedback, suggestions, or ideas regarding the Platform, you grant Yourever a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without restriction or compensation.
11. Indemnification
You agree to indemnify, defend, and hold harmless Yourever and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Platform; (b) your Content; (c) your breach of these Terms; or (d) your violation of any third-party rights.
12. Governing Law & Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions.
12.2 Dispute Resolution
Any dispute arising out of or related to these Terms or the Platform shall first be resolved through good faith negotiations over a period of thirty (30) calendar days. If the dispute cannot be resolved through negotiation, it shall be settled by binding arbitration in Jakarta, Indonesia, in accordance with the rules of the Indonesian National Board of Arbitration (BANI). The arbitration shall be conducted in Indonesian.
12.3 Injunctive Relief
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending the resolution of arbitration.
13. Modification of Terms
Yourever reserves the right to change these Terms at any time. Material changes will be notified via email and through the Platform dashboard at least fifteen (15) calendar days before the changes take effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Platform.
14. Miscellaneous
14.1 Entire Agreement
These Terms constitute the entire agreement between you and Yourever regarding the subject matter herein and supersede all prior agreements, understandings, and communications.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14.3 Waiver
No waiver of any provision of these Terms shall be effective unless in writing and signed by the party against whom the waiver is sought to be enforced.
14.4 Assignment
You may not assign or transfer these Terms without prior written consent from Yourever. Yourever may assign these Terms without restriction.
14.5 Force Majeure
Yourever shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, war, terrorism, labor disputes, or government actions.

15. Platform Neutrality & Member-to-Member Transactions
15.1 Member-to-Member Sub-Renting
Yourever may provide communication infrastructure for Inner Circle members to facilitate sub-renting or other transactions between members (collectively "Member-to-Member Transactions"). Yourever acts as pure infrastructure for Member-to-Member Transactions and is not a party to any contract, agreement, or arrangement between members. Yourever has no obligations regarding payment, asset return, or performance of any Member-to-Member Transaction.
15.2 Member-to-Member Disputes
Any disputes arising from Member-to-Member Transactions are the sole responsibility of the involved members. Yourever will not act as a mediator, arbitrator, or referee in such disputes. Members agree to hold Yourever harmless from any claims arising from Member-to-Member Transactions.
